Overview

Yes, electronic wills are generally valid in Florida when they are signed and witnessed the way Florida law requires. Since July 1, 2020, you can sign your will on a screen instead of on paper.

How an Electronic Will Works in Florida

  • You sign the will with an electronic signature, which you add on a computer or tablet.
  • Two witnesses watch you sign and then sign it too.
  • Witnesses can be in the room with you or join by live video through an approved online notary.

Who Should Be Careful

Remote witnessing has extra safeguards. If you are a "vulnerable adult," meaning someone whose illness, disability or age makes it hard to protect themselves, your witnesses must be in the room with you.

Is a Paper Will Still Fine?

Yes. A paper will that you sign in front of two witnesses, who then sign in front of you and each other, is still valid. An electronic will is simply another option.
